As a state judge I resent that remark! Not really, Uncle Clif...keep em coming

Good for you. We need honorable judges!

As a Forensic Medicine Physician (MD) with 30 years experience, I can assure you there are no honorable judges. Maybe a few 'neutrals,' but honorable, NO!!!

Expand full comment

Bravo! I fully agree...

However... currently, I find that there are VERY few honorable MDs around either. they have become corrupt Big Pharma puppets, drug pushers... healing has nothing to do with it, and is actually frowned upon, as it breaks up the cash-flow.

Further proof... how many stood tall against the restrictions on prescribing healing/preventive drugs for Covid... like Ivermectin, HCQ, etc?? How many actively protested the bounties paid to hospitals for using the killer Remdesivir, or for the insane intubation protocols... and big bounties for Covid classified DEATHS??

As someone who has practiced, pro se, in state, federal and administrative court actions, absolutely everything you say is true. The judges advocate for the state, and tailor their "rulings" according to state interests. That being said, lawyers today don't do LAW, they do "procedures." They file paperwork according to a certain "trained" acumen. To beat them you have to, just like in martial arts, take them outside of their fight strength. You have to attack them in intellectual ways that their law school never prepared them for, i.e. jurisdiction, agency, delegation of authority authorizations, state constitutions, federal statutes, etc, and most importantly, you have to destroy their case via your discovery requests. Discovery is where you break their will to proceed. You unveil documents, photos, video, affidavits, all and sundry that proves, unquestionably, your position. If they decline the discovery request, you file the Motion to Compel Discovery and in that instrument you present your case to the judge. You can tell your side of the story, as you see fit without testifying, prep the battlefield, and cast a shadow of doubt over your opponent in front of the judge. Its a chess game that not everyone can play and sadly the ones who can, really can't.

Because you don't check them. When a judge acts a fool you boot him. In California its a 170.3, 170.6 motion depending on the circumstances. Then you can file a Writ of Mandate to a higher court seeking an "Order" against the lower court. It works, and that is real. A lower court judge, referee, or commissioner is subject to the Superior Court and the Superior Court is subject to the appellate branch. You have recourse but you have to know how to use it.

ya, i don't enjoy contempt in jail after i file the writ, happened 2x

Expand full comment

Then you sue under 42 USC 1983 in federal court. They can't contempt you for seeking redress by lawful court process. Contempt has to be verbal or by actions or conduct deemed unlawful. Seeking due process is a right. What state?

I have 5 attorneys in my family.... And I can tell you that yes there are many corrupt judges out there that put their self interests and financial gain ahead of the oath they took to uphold the Constitution. However there are many many MANY honorable judges that care deeply about this country and the Constitution and are willing to rule fairly even though it may be against their personal beliefs or wishes.

Judges are people, on balance no better or worse than other people. Some good, some bad, a few truly terrible.

The problem is when the appointers of judges go out of their way to appoint corrupt lawyers who will rule the way the appointers want. Which is where we are today -- the whole system has become corrupted.

So true!!! I'm currently in a litigation for stolen property (which the lawyers call "conversion"). The judge made a pre-trial ruling that I only have property rights on one, specific day, and I am only entitled to the specific items, which one, specific friend, specifically requested, with my express authority, and which he was also ready, and willing, and able to take possession of, on the one, specific day. I am not exaggerating, that is literally what the Court Order says, word for word!!!!! All property that undisputedly belongs to me, I have no right to, if it does not meet every requirement stated in the order. The judge refuses to state the reason the order was made, and will not state what law or Appellate decision allows for it. (Obviously because there isn't one!) The level of corruption has truly shocked me to the core. I honestly wouldn't believe our "justice system" was this corrupt if I wasn't experiencing it myself, first hand. We really truly have to abolish this entire system.

Expand full comment

I should also mention that the “property” is literally everything I had, including everything for my business, and my livelihood, totaling more than $1 million. The theft/conversion of this property resulted in me becoming homeless and living in my car for about a year. And now I'm being bankrupted for a second time, as this litigation has been going on for +4.5 years, as the court tries to figure out what one of my friends said and did on one random day, and pretending that this is what f-ing matters. The system is a complete fraud. There is no justification for a ruling stating that the words and actions of another person, on one, random day, 100% determines what rights you have to everything you worked your entire life for. I am beyond disgusted with this institution, and everyone involved in it. Most Judges are narcissistic sociopaths who get off on screwing with people.

@Brianna - You're losing your cases because you're playing by THEIR RULES. It's a GAME and you will have to figure out how to CHANGE THE RULES in your favor. If you're really clever, there may even be a way to recover your property. But it will take research and work on your part. I've left a comment with some resources above. See if they are of any help to you. Good luck!

Remember too, Judges are appointed by political appointments. Party in charge puts in “their” guy. Some Judges have no legal degree, while handing down sentences in remote jurisdictions. There is no “Judge school” or

“Judge degree”. The Bar Association members sometimes “vote” for Judges based on the criteria of “easiest to win in front of” or “colleague that’s a great friend to all” or “let’s dump this crap job on Mikey cause the pay is not enough money for the rest of the local lawyers to want the job”. This is just some of the PROFESSIONAL criteria used. Even worse, sometimes the public votes for a Judges and they win by a whopping 32 votes out of 50,000 voters who showed up that day. The 32 voters voted straight party and have no idea who they voted for. The rest ignored any choice. 🤷‍♀️

Not in all states.

Well even if the Governor appoints and Legislature approves it always on party lines. Same with Federal appointments. Being in the legal field for 40 + years in 3 states one a Commonwealth, I haven’t seen any other way. Merit is still by appointment or vote.

So when Judge Roberts continuously rules "no standing" on all cases contesting the Presidential election (Obama and Biden) he is correct as the United States is a private corporation founded in 1871. The owners could place anyone of their choosing into the White House irrespective of eligibility or competitence. Obama was ineligible and Biden is seriously incompetitent. Great essay Clif.

No lover of the man, but Obama's mom was without dispute a US citizen, ergo Obama was a natural-born citizen, as in 'entitled to US citizenship at birth.' Even if he was born in Kenya, or on the moon.

All this stuff about 'born on US soil' is a misinterpretation of the law, and must go. No anchor babies.

Expand full comment

“Natural Born Citizen” means both of your parents were citizens at your birth. You can still have citizenship if only one is a citizen, but for the purpose of being eligible to be President of the United States, you must be “Natural Born”, ergo both parents, at your birth.

The physical location of your birth is irrelevant.

Expand full comment

The exact interpretation of this wording in the Constitution has never been settled by the courts.

"There is some debate over whether or not one may also be a natural born citizen if, despite a birth on foreign soil, U.S. citizenship immediately passes from the person's parents."

So, I'd say your interpretation and mine, while slightly different, are both possible. 💖

"Legal cases are decided by judges based entirely on the judges own self interest." Isn't this why the right to trial by jury is so fundamentally important?

No, the preferable method of resolution with the judiciary is always settlement, not controversy. Most of the time that is not possible with the profane, but those of brighter lights always prefer quiet settlement. Judges are called, "arbiters" for a reason.
